Face Shoplifting Charges with Denver Retail Theft Lawyer Kimberly Diego
While popular culture has largely portrayed shoplifting as nothing more than a symptom of a rebellious teenage phase, the Colorado judicial system takes shoplifting charges very seriously. Shoplifting is a form of theft and, just like any other criminal conviction, can have serious and far-reaching negative consequences. Depending on the value of the items stolen, someone convicted of shoplifting may face fines, jail time, and a criminal record that will make it difficult to do things like apply for college, get a job, or join the military. Because of the harsh penalties, it’s essential that anyone accused of shoplifting contact a skilled Denver defense attorney as soon as possible.
Colorado theft attorney Kimberly Diego can provide you with the sound legal counsel and assertive representation that you will need to defend yourself against the charges you are facing. Even if you firmly believe the entire situation was just a silly misunderstanding, you can’t assume that the courts will see it that way. You will need the expertise of someone who understands the Colorado judicial system, shoplifting laws, and the specifics of your case. Do not leave your future to chance: contact Denver criminal defense lawyer Kimberly Diego for the help you need in your shoplifting case.
Don’t Let One Mistake from Destroy Your Future: Use a Lawyer
There are many different and complex reasons why people shoplift. Sometimes a shoplifting crime is committed under stress or in a moment of panic. Teenagers, in particular, may feel pressured by friends to shoplift an item in order to fit in, although adults can also experience societal pressures that lead them to shoplift. Whatever the specific reasons, most people realize they’ve made a mistake soon after stealing something and feel remorseful.
Denver defense attorney Kimberly Diego recognizes that someone who has shoplifted isn’t a bad person—they’re just someone who has made a mistake. While theft is illegal, shoplifting isn’t something that should carry harsh and far-reaching penalties like a criminal record lasting for the rest of someone’s life. Whether working with a juvenile or adult client, Ms. Diego will work to convince the prosecution that charges should be reduced, deferred, or dropped altogether.
Kimberly Diego Knows the Nuances of Theft and Shoplifting Laws
The severity of the charges against you and the potential penalties you face for shoplifting largely depends on the value of the merchandise that you allegedly stole, as well as whether or not this is the first offense. For example, a first-time theft of less than $500 worth of merchandise is considered a class 2 misdemeanor and carries with it a maximum penalty of between 3 months to 1 year in jail and $250-$1,000 in fines, while an alleged theft of more than $1,000 worth of merchandise is a class 4 felony, which can result in 2-6 years of prison time and $2,000-$500,000 in fines. If you have two or more shoplifting incidents and are alleged to have stolen more than a collective $1,000 worth of merchandise in 6 months, you will also face a felony charge.
Of course, a charge is not the same as a conviction, and a good shoplifting attorney will aggressively defend you to make sure that you don’t face the maximum penalties. Denver criminal defense attorney Kimberly Diego has extensive experience defending clients facing misdemeanor and felony shoplifting charges, and she has the expertise to understand how the laws and regulations apply to your specific case. With Ms. Diego as your Denver criminal lawyer, you will have the peace of mind of knowing that you have an advocate who will compassionately guide you through all the phases of your case while assiduously pursuing the very best outcome possible for you.
A Rigorous Defense Can Make a Difference in Your Shoplifting Case
In shoplifting cases, it’s up to the prosecution to prove certain things in order to have a strong shoplifting case against you, including:
That you were seen approaching the merchandise
That you selected or picked up the merchandise
That you concealed or otherwise carried away the merchandise
That a store clerk or other witness continuously observed you from the moment you were seen approaching the merchandise until you left the store
That you did not pay for the merchandise
That the store clerk approached you outside of the store
If you retain criminal defense attorney Kimberly Diego, she will carefully examine your case and analyze all the details in order to build the best defense possible. If any part of the prosecution’s case is weak, she may be able to negotiate with the prosecutor to get the charges against you lowered, or in some cases, dropped altogether. Your best chance of getting a positive outcome in your case is to work with an experienced and aggressive shoplifting attorney like Ms. Diego.

I had no experience with the justice system when I got my charge and would have been COMPLETELY lost in court without Kimberly there to get me through the process! I was certain I would at least get probation and fines, but Kim actually got my case dropped in the end! I couldn't believe it! I had other lawyers tell me I was in for much more but Kim went above and beyond to get the job done with the utmost integrity and professionalism! I would highly recommend her to anyone needing an attorney. Thanks again, Kim!

hen I started looking for a criminal lawyer to help with my husband's criminal case, I went through many initial consultations with other lawyers which resulted in me getting turned away because they felt our situation was hopeless. When I contacted Kimberly via email to ask if she thought she could help, I had barely just sent out the email when I saw a response from her. She told me she was confident she could help us, and she just made me feel so positive about everything. Kimberly has always been quick to respond, and she is great at mixing her professionalism with her compassion for the law and helping people get through their issues. I never doubted that she would help my husband get his open warrant lifted while he could not appear in person. We currently live in Brazil and we needed his warrant lifted in order for us to be able continue the immigration process, and despite all of the odds against us, she still did it! I highly recommend her services if you are looking for someone who is personal and professional, good at what they do, and not afraid to take on difficult cases. My husband's case is not yet finished completely yet, but we know Kimberly will get us through it!

We contacted Kimberly Diego for a DUI that involved some very difficult circumstances with law enforcement officers. Upon dealing with this very serious situation, I knew that it was going to be complicated and difficult to get through. I was facing my 3rd DUI conviction, yet the law enforcement officers in this case acted unethically. Kimberly was diligent in hiring two key investigators to gather information that would benefit my case, and in the end all the work aided in the DUI charge being dropped. Although my wife and I never want to go through a situation like this again, we would recommend Kimberly for a defense attorney. Her focus, will to not quit, and focus to the detail that was necessary for my case, were all key in her work with me. Kimberly is very busy yet we learned quickly that she was doing the work necessary to be ready for our court date. We highly recommend Kimberly!

I was truly fortunate to have Kimberly Diego as my Lawyer. She seems to practice law because she believes in the judicial process. Her negotiation skills and knowledge put me at my best advantage with respect to defending myself. It was evident in court that she was a trustworthy expert, and enabled me to enter a fair and reasonable plea. Her representation gave me confidence, and helped put my life back on track, a sort of reform that jail time or longer probation could never have accomplished. Moreover, Ms Diego is a realist, but still took on challenge. She went above and beyond what any other lawyers I spoke with could not even fathom. She did what was necessary to represent me in all aspects of my defense needs. Finally Ms Diego was efficient and worked quickly keeping the amount of billable hours to a number I could afford. I highly recommend Ms Diego as a defense lawyer.

Hello Kim, I wanted to thank you for representing me with my recent incident in the Boulder area. You wasted no time in contacting the court to address my case. We we received feedback from the court about my case, you were not satisfied with their statement for my outcome. You took the case back to them, and you presented reasons for them, to offer me a better deal. I believe I received the best outcome I could possibly receive, for my situation. If I have another opportunity to use you again, I would certainly not hesitate, in calling you for my representation. Thank you again, for your help.

I contacted Kim concerning a case, which involved Indecent Exposure charges. Throughout the entire episode, she remained professional and courteous. I found her fees to be reasonable and fair. I was prepared to plea to the lesser charge, in exchange for a dismissal of the Indecent Exposure charge. After she explained she got both charges dismissed, I raised both my hands in triumph.

Crimes involving computers can be a bit confusing. That’s because the internet provides users anonymity along with a false sense of security. So when something does go wrong and a crime like digital forgery occurs, what happens next?
The internet can be a dangerous place and the laws surrounding crimes perpetrated using it are relatively new. Here’s what you need to know.
Felony murder is a serious offense in the state of Colorado and carries with it significant penalties. Some lawmakers aren’t so sure, however, that this sweeping rule is right in every circumstance. Some are working to change it.
State legislators in Colorado introduced a bill that would change the way the state treats those that were involved in the murder but didn’t actually commit murder themselves.
The holidays are here. In fact, the holiday season in the United States starts with Halloween and doesn’t end until after New Year – which means two solid months of celebration happening in Colorado and across the country.
Unfortunately, some of these celebrations end in arrests for driving under the influence (DUI). In fact, in the last several years, Halloween has seen an uptick in DUI arrests, with over 200
