Client allegedly verbally threatened then physically assaulted his wife. Ms. Diego persuaded the assistant district attorney that there was insufficient evidence on which to proceed, in part due to the credibility of the alleged victim. The case was dismissed.
06/2010: Client charged with DUI after driving his brother home from a get together.
After cross examining the arresting officer, Ms. Diego argued to the Court that the officer lacked reasonable suspicion to stop her Client’s vehicle. The Court agreed, and suppressed all evidence. The case was then dismissed. Ms. Diego also represented the Client at his DMV hearing, at which the hearing officer decided in his favor, thus allowing him to keep his license.
